These Terms and Conditions ("Agreement") govern your use of the Kushk platform (the "Kushk Solution"), provided by Tech for Technological Development LLC ("Provider," "we," or "us"). By accessing or using Kushk, you agree to be bound by the terms set out below.

Acceptance of Terms

By accessing or using Kushk, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, you may not use Kushk.

License

Subject to this Agreement, Provider grants you a limited, non-exclusive, non-transferable license to access and use Kushk for the purpose of building and managing online stores in the cloud. This license is granted solely for your personal or business use and is subject to compliance with this Agreement.

User Responsibilities

You are responsible for maintaining the security of your account, including keeping your login credentials confidential. Any activity that occurs under your account is your responsibility.

You agree not to use Kushk for any illegal or unauthorized purpose, and you must comply with all applicable laws and regulations.

You are solely responsible for the content and products you upload, display, or sell through Kushk. You warrant that you have the necessary rights to use, reproduce, and display that content and those products.

Data Security and Privacy

Provider will take reasonable measures to protect the security and integrity of your data stored or processed through Kushk.

Provider will collect, use, and disclose your personal information in accordance with its Privacy Policy.

Payment and Subscription

To access Kushk, you may need to subscribe to a paid plan. The fees for each plan are displayed on our website.

Provider reserves the right to change fees or subscription plans at any time upon notice to you.

Fees for Kushk are non-refundable. You are responsible for paying all fees incurred for your subscription.

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Provider reserves the right to suspend or terminate your subscription if you fail to pay the applicable fees.

Intellectual Property

Provider owns all intellectual property rights in Kushk, including but not limited to trademarks, copyrights, patents, and trade secrets.

You acknowledge that you have no right, title, or interest in or to Kushk except for the limited license granted in the License section.

You agree not to reproduce, modify, distribute, display, or create derivative works based on Kushk without the prior written consent of Provider.

Indemnification

You agree to indemnify, defend, and hold harmless Provider, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with your use of Kushk or any violation of this Agreement.

Limitation of Liability

Provider will not be liable for any damages, whether direct, indirect, incidental, consequential, or punitive, arising out of or in connection with your use of Kushk.

In no event shall Provider's liability to you exceed the total amount paid by you to Provider for Kushk during the six (6) months preceding the claim.

Termination

Provider may terminate this Agreement and your access to Kushk at any time without notice if you breach any provision of this Agreement. Upon termination, you must cease all use of Kushk.

Miscellaneous

This Agreement constitutes the entire agreement between you and Provider and supersedes all prior or contemporaneous communications and proposals, whether oral or written.

This Agreement shall be governed by the laws of the Sultanate of Oman, without giving effect to any choice or conflict of law provision.

Any dispute arising out of or in connection with this Agreement shall be resolved through binding arbitration in accordance with the rules of the Sultanate of Oman.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Provider's failure to enforce any right or provision of this Agreement shall not be deemed a waiver of that right or provision.

By using Kushk, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you may not use Kushk. Questions? Contact us at info@kushk.io.
